Allen J. Erreich has been advising clients on employee benefit matters for over 25 years.
He advises plan sponsors on the design and implementation of all types of tax qualified retirement plans, including the drafting and review of plan documents and amendments reflecting plan design and regulatory changes. He counsels clients on all aspects of plan administration and compliance, including, for example, nondiscrimination testing, audits of plan financial statements in connection with annual Form 5500 filings, qualified domestic relations order determinations and employee communications such as Summary Plan Descriptions and other plan related disclosures. He has advised defined benefit plan sponsors on pension plan de-risking strategies and the structuring and implementation of phased retirement programs. He has substantial experience with correcting plan administration errors through IRS and Department of Labor voluntary filings and has advised clients whose retirement plans are under audit by the IRS and Department of Labor. In addition, Allen has advised owners of self-directed IRAs on the structuring of their IRA investments to comply with the Internal Revenue Code’s prohibited transaction requirements and provided advice to private investment funds on issues relating to the structuring of underlying investments to comply with applicable ERISA requirements. He has also participated in negotiating employee benefits issues in mergers, acquisitions, and other corporate restructurings.
